The complete terms governing your use of Miyzon telecommunications services.

These Terms and Conditions ("Terms") constitute a legal agreement between you ("Customer," "you," or "your") and Miyzon Pty Ltd ABN: XX XXX XXX XXX ("Miyzon," "we," "us," or "our") for the provision of telecommunications services.
By signing up for, activating, or using any Miyzon service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our services.
These Terms should be read in conjunction with our Privacy Policy and Critical Information Summary.

You apply for Service by:
Your application is an offer to enter into this agreement. We may accept, reject, or request additional information before accepting your application.
This agreement commences on the earlier of:
We may require proof of identity and address before activating Service. This may include driver's license, passport, utility bills, or other documents. We reserve the right to refuse service if adequate verification cannot be obtained.
We may conduct credit checks and require credit card or bank account details before service activation. We may also require a security deposit for customers who do not meet our credit criteria.

We do not guarantee that Service will be available at all locations or that any particular speed tier will be achievable.
We will use reasonable endeavours to provide Service at the speeds advertised in your CIS. However, actual speeds may vary due to:
Speeds advertised are "typical evening speeds" measured between 7pm-11pm as required by ACCC guidelines.
While we advertise "unlimited data," our Fair Use Policy applies:
We aim for 99.9% network uptime, calculated monthly. This excludes:
We may perform planned maintenance that temporarily interrupts Service. We will provide:
You must provide accurate, complete, and current information when applying for Service and promptly notify us of any changes to:

You agree to pay all charges as set out in your CIS, including:

We may change our prices with 30 days' written notice. Price changes do not apply retrospectively. You may cancel Service without penalty if you do not accept the price increase.
We may suspend Service if:

You may terminate Service at any time by:
No exit fees apply. Service remains active until the end of your current Billing Period. No refunds for partial months.
We may terminate Service immediately if you:
We may also terminate on 30 days' notice if we discontinue Service in your area or cease operations.

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law, including consumer guarantees that:
To the maximum extent permitted by law, we exclude liability for:
Where liability cannot be excluded, it is limited to resupply of the Service or refund of charges paid for the affected period.
You indemnify us against all claims, damages, and expenses arising from:
We are not liable for failure to perform obligations due to events beyond our reasonable control, including natural disasters, strikes, war, government actions, or network failures outside our control.

If your complaint is not resolved to your satisfaction, you may escalate to the TIO:
The TIO provides free, independent dispute resolution for telecommunications complaints.

These Terms are governed by the laws of New South Wales, Australia.
You may not transfer or assign your rights or obligations under these Terms without our written consent. We may assign these Terms to a related company or purchaser of our business.
We may amend these Terms at any time by:
Continued use of Service after changes take effect constitutes acceptance.
If any provision is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.
Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it later.

These Terms, together with your CIS, Privacy Policy, and any applicable service schedules, constitute the entire agreement between you and Miyzon and supersede all prior agreements or understandings.
